These Terms of Service ("Terms") govern your access to and use of the Yemflow platform and services (the "Service") operated by Yemflow ("we," "us," or "our"), a sole proprietorship registered in the Province of Alberta, Canada. By accessing or using the Service, you agree to be bound by these Terms.
Yemflow provides a marketing automation platform for small businesses, including AI-powered chatbot, missed call text-back, appointment scheduling, automated SMS and email workflows, lead management, a unified inbox, and a mobile application.
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and all activity that occurs under your account. You must be at least 18 years old to use the Service.
Monthly Subscription: The Service is offered on a monthly basis. All prices are in Canadian Dollars (CAD). See our Pricing page for current fees.
Usage-Based Charges: In addition to your monthly subscription, you will be billed for SMS messages, phone calls, AI chatbot usage, and phone number rental based on actual usage.
Payment Processing: Payments are processed securely through Stripe.
Failed Payments: If a payment fails, we may suspend your access until payment is received.
A one-time setup fee applies for new accounts. Promotional offers including discounted setup fees are subject to availability and may be modified or discontinued at our discretion.
Cancellation: Cancel anytime by contacting support@yemflow.com. Cancellation takes effect at the end of your current billing cycle.
Refunds: Subscription fees and setup fees (once initiated) are non-refundable.
Account Data: Upon cancellation, your data will be retained for 30 days then permanently deleted.
You agree not to use the Service to send unsolicited messages, harass or harm any person, violate any applicable laws (including CASL), transmit malicious code, gain unauthorized access to systems, or resell the Service without written consent.
You are responsible for obtaining proper consent from recipients before sending text messages, in compliance with CASL. Recipients may opt out by replying STOP. Message and data rates may apply. SMS consent is not a condition of purchasing or using the Service.
Yemflow is not responsible for delays, failures, or errors in SMS or call delivery caused by mobile carriers or factors beyond our control. Mobile carriers are not liable for delayed or undelivered messages. Message and data rates charged by your carrier are your responsibility.
You retain ownership of all data and content you upload or transmit through the Service. You grant us a limited license to process it solely for providing the Service. You are responsible for ensuring your content complies with applicable laws.
The Service and all related intellectual property is owned by Yemflow or its licensors. You may not copy, modify, or distribute the Service or create derivative works from it.
The Service integrates with third-party services including Stripe, telecommunications providers, and other platforms. We are not responsible for the availability or practices of any third-party services.
The Service is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the total amount you paid us in the three months preceding the claim.
You agree to indemnify and hold harmless Yemflow from any claims arising from your use of the Service, violation of these Terms, or content you send through the Service.
We may suspend or terminate your access at any time if we believe you have violated these Terms.
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada. Disputes shall be resolved in the courts of Alberta.
